Sado Estuary: building on rural land now requires an ICNF opinion

Decree-Law no. 189/2026 (Decreto-Lei n.º 189/2026), published in the Diário da República on 21 September 2026, completes the designation of the Sado Estuary Special Area of Conservation (ZEC, PTCON0011) and sets protection rules for this area and for the Special Protection Areas (ZPE) of the Sado Estuary and Açude da Murta. It enters into force on 22 September 2026 (article 15).
According to the site record in ICNF's Natura 2000 Sectoral Plan, the ZEC covers about 31,000 hectares in the municipalities of Alcácer do Sal, Setúbal, Palmela, Grândola and Vendas Novas.
What changes now
Until the municipal plans are revised or amended, any building on rural land (solo rústico) inside the ZEC and ZPE needs a favourable opinion from ICNF, the nature conservation authority (article 4(4)):
- ICNF has 30 working days to respond; if it does not, the opinion is deemed favourable;
- an unfavourable opinion can be appealed to the minister responsible for the environment within 30 days;
- the rule does not apply where the municipal plan already meets the new requirements.
Article 5 applies directly across the whole area. For example, it bans soil works deeper than 10 cm that damage the roots of cork and holm oaks. It also makes several activities subject to an ICNF opinion, including changes between farming and forestry uses on continuous areas larger than 0.5 ha, changes to the topography of wetlands, water abstraction and drainage, and sealing land with impermeable surfaces.
What the PDMs will have to include
The municipal master plans (PDM) of the municipalities concerned will have to ban new building on rural land in the area, with exceptions (article 4(2)). These include:
- reconstruction, demolition, alteration and maintenance works;
- extensions of lawfully existing homes, as long as the total built and sealed footprint does not exceed 200 m²;
- tourism extensions of residential or tourist buildings up to 500 m² of footprint, with no additional floors;
- a home for the owner of a working farm or forestry holding.
Most permitted building will still need an ICNF opinion. Extensions of up to 50% of the existing footprint, or whose total added area does not exceed 100 m², are exempt (article 4(3)). Renewable energy installations on rural land also need an opinion, except in rural settlements and areas of scattered building, on licensed buildings and for small self-consumption units (UPAC) of minor planning relevance.
If you own land near the Sado
- Check whether the plot lies inside the ZEC or ZPE. The boundaries are on ICNF's Natura 2000 maps and in the PDM plans.
- If it does and the land is classified as rural, allow up to 30 working days for the ICNF opinion in your project schedule.
- If you already have an application with the municipality, check whether it now needs this opinion.
A management plan for the area will be approved later by ministerial order (portaria, article 13).
